The purpose of the Website is to provide you with information about the services and activities of the Blue Systems division of the Bolloré Group, and with links to the different websites of the entities within this division.

“Blue Systems” is a brand that belongs to the Bolloré company (registered within the RCS [Companies Register] of Quimper under number 055 804 124). Within these General Terms, Blue Systems may refer to all the companies within the division together under the same name, or under the name of the division, Blue Systems, according to which is applicable in the context.

 

General Terms of Use for the Website

a) Acceptance of the General Terms of Use
The Website User (the “User”) acknowledges that they have read all the provisions of these general Terms of Use (the “GTU”) and declares to accept them irrevocably and fully.

The Publisher may update the GTU at any time. Therefore, the User is encouraged to regularly refer to the current and up-to-date GTU.
Notwithstanding the use of the expressions “we” and “our”, it should be noted that each of the companies within the Blue Systems division has its own legal identity and that such usage shall not imply any unity between them.

 

b) Obligations of the User
The User acknowledges that they have the skills and resources necessary to access and use the Website.
The User must, in particular, refrain from collecting and using the personal information they may access through the Website in any fraudulent manner, and, in general, refrain from any act liable to infringe the privacy, honour, sensitivity or brand image of any natural or legal person, and in particular the Publisher, its subsidiaries, affiliated entities and management, avoiding any defamatory, provocative, malicious, derogatory or menacing reference, message or text, by whatever medium. Such content shall be immediately deleted by Blue Systems.
The User undertakes to not use the Website and the information or data contained therein for commercial, political or publicity purposes, or for any form of commercial solicitation, in particular the sending of unsolicited emails.
Furthermore, the User undertakes to not interfere with the functioning of the computer systems, nor usurp or hijack the identifiers, names or attributes of other Users, and, in general, to not carry out any action that may create confusion among the Users.

 

c) Contact
The User may, if they so wish, contact the Blue Systems entities by sending an email to the following email address: contact@bluesystems.ai. As indicated in the Terms relating to the Personal Data Protection Policy, information provided by the User in this way shall be used by any Blue Systems entity to allow exchanges between the User and any entity from the Blue Systems division.

The information that the User is requested to provide when they contact us will only be used by the Blue Systems entity/entities concerned, and only in order to respond to the User’s request; in no event shall this information be used for commercial purposes or be passed on to a third party, except in order to comply with any legal or regulatory requirement.

In accordance with the applicable regulations, Users have the right to access, oppose, amend and delete their personal data, and may exercise these rights under the conditions set out in the Personal Data Protection Policy.

 

d) Intellectual and industrial property rights
Subject to the rights expressly granted by the Publisher, intellectual property rights relating to the documents contained on the Website and each of the elements created for the Website are the exclusive property of the Publisher, who does not grant any licence, nor any right other than that of visiting the Website. In particular, trademarks and other intellectual property rights listed on the Website are the property of the relevant entities from the Blue Systems division. The reproduction of any documents published on the Website is only authorized exclusively for the purposes of information, for personal and private use; any reproduction and any use of copies made for other purposes is expressly prohibited.

 

e) Website management
For the purposes of good management, the Publisher may at any time:
−    suspend, interrupt or limit access to all or part of the Website;
−    delete any information that may disrupt the functioning of the Website or be in contravention of French or international laws,
−    suspend the Website in order to carry out updates.

 

f) Information provided in relation to Blue Systems
Blue Systems endeavours to ensure that the information provided on the Website is accurate and up-to-date and reserves the right to correct the content, at any moment and without warning.
However, Blue Systems cannot guarantee that the information made available on the Website is accurate, precise or exhaustive, including all hyperlinks and any other data link directly or indirectly accessible through the Website.

Therefore, Blue Systems and the entities within it accept no responsibility:
−    for any error, inaccuracy or omission relating to the information available on the Website;
−    for any damages resulting from a fraudulent intrusion by a third party causing information available on the Website to be modified;
−    more generally, for any direct or indirect damages, whatever the causes, origins, nature or consequences, caused by anyone accessing the Website or not being able to access it, as well as the use of the Website and/or the credit attributed to any information coming directly or indirectly from the latter.

The Website may contain certain non-historic data constituting forward-looking statements, and in particular forecasting statements relating to future events, trends, plans and/or objectives. These statements are based on the current views and hypotheses of the management and are subject to significant risks and uncertainties, which may result in a significant difference between the actual results and those contained explicitly or implicitly in these statements (or the previous results). It must under no circumstance be interpreted as a solicitation and nor does it constitute an offer to subscribe, purchase or exchange shares or other securities from any entity within the Blue Systems division. This information has not been audited by the competent authorities as required within the framework of procedures relating to the offer of securities to the public.

 

g) Responsibilities
The Publisher shall not be held responsible for a lack of availability of all or part of the features of the Website or for the presence of a virus or malware on the Website.
The Publisher cannot be held responsible in the event of error, fault, crash, operation problems or downtime that disrupts access to the Website or one of its features.
The User assumes full responsibility for the equipment they use to connect to the Website. The User must take all appropriate measures to protect their equipment and their own data, in particular against virus attacks online.

The Publisher cannot be held responsible in the event of legal proceedings against the User as a result of using the Website or any service accessed through the Internet, or as a result of the User not complying with these GTU.

The Publisher is not responsible for any damages suffered by the User, third parties and/or the User’s equipment as a result of them connecting to or using the Website and the User shall thereby refrain from taking any action against the Publisher.

 

h) Hypertext links
The User is prohibited from introducing hypertext links to all or part of the Website, without prior written consent from the Publisher.
The Publisher is free to refuse this authorization without being required to justify its decision in any way. In the event that the Publisher grants such authorization, this is in all cases only temporary and may be withdrawn at any time, without the obligation to provide justification on the part the Publisher.

In any case, any link must be removed at the request of the Publisher.
Any information accessible through a link to other websites is not under the control of the Publisher, who accepts no responsibility with regard to the content thereof.

 

i) Applicable law
These GTU are governed by French law and subject to the exclusive competence of the courts of Nanterre, subject to a specific assignment of jurisdiction resulting from a particular piece of legislation or regulatory text.
